This Privacy Policy describes how MODTURA ("MODTURA," "we," "us," or "our") collects, uses, shares, and protects information when you visit modtura.com, contact us, become a partner, sign up for a website plan, or use any service we provide. It applies to information we collect about prospective and current partners, prospective and current clients, and visitors to our website.
If you have questions, you can reach us at hello@modtura.com.
When you fill out a form on our website, sign a partner agreement, sign a client order form, or correspond with us, you may provide information such as your name, business name, email address, phone number, mailing address, the type of business you operate, the services you are interested in, and any other information you choose to share.
When you visit modtura.com or any website we host, we automatically collect technical information including your IP address, browser type and version, operating system, device type, referring URL, the pages you view, the time of your visit, and similar information through cookies, log files, and analytics tools.
When a client pays for a plan or a partner receives a payout, the financial information needed to process that transaction (such as card details, bank account details, or tax identification numbers) is collected and processed by Stripe, Inc., not by MODTURA. We receive a limited token and transaction metadata from Stripe so that we can identify the payment, but we do not store full card numbers or full bank account numbers on our systems.
Partners may share information about prospective clients with MODTURA in the course of making an introduction, including the prospect's name, business name, contact details, and basic context about the engagement.
To build and maintain a client's website, the client may share content such as text, images, video, brand assets, customer testimonials, employee information, product or service details, and login credentials for third-party tools we are integrating with. The client is responsible for ensuring they have the right to share that content with MODTURA.
Websites we host on behalf of clients may collect information from their visitors, such as form submissions, account details, and analytics data. The client is the controller of that information. MODTURA processes it on the client's behalf to operate the website, and the client's own privacy notice governs how visitors should expect their information to be handled.
We use the information described above to:
We do not sell your personal information. We share information only as described below.
We share information with vendors that help us run our business, including Stripe (payment processing), our hosting and infrastructure providers, our email delivery providers, our customer relationship and communication tools, and our analytics providers (including Google Analytics). These providers process information on our behalf under contracts that limit their use of the data.
If you are a prospect referred by a partner, MODTURA may share status updates with the referring partner about your engagement (for example, that you signed a plan or that the build is underway), so the partner can confirm the referral and receive their revenue share. If you are a client, we may share information about your account with your referring partner only to the extent reasonably necessary to administer the partnership.
We may disclose information when we believe in good faith that disclosure is required by law, subpoena, court order, or other legal process, or where disclosure is necessary to investigate or respond to suspected fraud, security incidents, or violations of our Terms.
If MODTURA is involved in a merger, acquisition, financing, or sale of all or part of its business, information may be transferred as part of that transaction, subject to standard confidentiality protections.
We use commercially reasonable administrative, technical, and physical safeguards to protect information from loss, misuse, unauthorized access, disclosure, alteration, and destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. If we become aware of a security incident that affects your personal information, we will notify you and any required authorities consistent with applicable law.
We retain personal information for as long as it is needed to provide our services, to comply with our legal obligations (including tax, accounting, and recordkeeping requirements), to resolve disputes, and to enforce our agreements. When information is no longer needed, we delete or de-identify it on a routine basis.
Depending on where you live, you may have rights regarding your personal information, including the right to access, correct, delete, or receive a copy of your information, the right to object to or restrict certain processing, and the right to withdraw consent where processing is based on consent.
If you live in California, you may have additional rights under the California Consumer Privacy Act, including the right to know what personal information we collect, the right to request deletion, and the right to opt out of the "sale" or "sharing" of personal information. We do not sell personal information.
If you are in the EEA, the UK, or Switzerland, you may have rights under the General Data Protection Regulation and equivalent local laws, including the rights described above and the right to lodge a complaint with your local supervisory authority. The legal bases on which we rely include performance of a contract, our legitimate interests in operating and improving our business, your consent (where required), and compliance with legal obligations.
To exercise any of the rights above, email us at hello@modtura.com. We will respond within the time required by applicable law and may need to verify your identity before acting on your request.
We use cookies and similar technologies on modtura.com to operate the site, remember preferences, and understand how the site is used. For details on what cookies we use and how to control them, see our Cookie Policy.
MODTURA services are intended for businesses, not for children. We do not knowingly collect personal information from anyone under thirteen (13) years of age. If you believe a child has provided us with personal information, contact us and we will take appropriate steps to delete it.
MODTURA is based in the United States, and information we collect is processed and stored in the United States. If you access our services from outside the United States, you understand that your information may be transferred to, stored in, and processed in a country whose data protection laws differ from those of your country of residence.
Our website and the websites we build for clients may contain links to third-party sites and services. We are not responsible for the privacy practices of those third parties, and we encourage you to review their privacy notices before sharing information with them.
We may update this Privacy Policy from time to time. When we do, we will revise the "Last updated" date at the top of this page. If the changes are material, we will provide additional notice (such as by email to active clients and partners, or through a prominent notice on the website) before the changes take effect.
